29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a. On or about May 28, 2020, located at Building 15, employees were framing on the second floor of an apartment building without guardrails or any other means of fall protection at the front and back of the building, thereby exposing the employees to a fall hazard of approximately 10 feet. b. On or about May 28, 2020, located at Building 15, employees were framing on the second floor of an apartment building without a top rail on six window openings thereby exposing the employees to a fall hazard of approximately 10 feet.

29 CFR 1926.1427(a): The employer must ensure that each operator is trained, certified/ licensed, and evaluated in accordance with this section before operating any equipment covered under subpart CC, except for the equipment listed in paragraph (a)(2) of this section. a. On or about May 28, 2020, a P&H mobile crane model CN-122, serial number 56494, was operated to hoist building materials. The employer did not ensure that operators of the mobile crane were certified/licensed and evaluated to safely operate the crane.
