OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to being struck by polyvinyl chloride pipe fragmentation: a. On or about May 28, 2020 and at times prior, employees working and walking through the north saw, shaper and belt sander areas of the shop, were exposed to the hazard of being struck by flying shards of polyvinyl chloride piping, in that the compressed air (140 p.s.i.) was passed through polyvinyl chloride piping from the air compressor to the branch and air hose connections.

On or about May 28, 2020 and at times prior, the owner exposed himself and employees to amputation hazards, in that they operated the Rockwell Unisaw, a circular handfed ripsaw to rip and cut wood without a blade guard.
