29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use. a) At Inglemoor Rehabilitation and Care Center of Livingston, on or about April 23, 2020, and thereafter, where the use of respiratory protection, including but not limited to the use of N95 respirators, was required for Registered Nurses (RNs), Licensed Practical Nurses (LPNs), and Certified Nursing Assistants (CNAs) providing direct patient care and housekeeping staff providing support functions to patients who were suspected or confirmed positive for COVID-19, the employer did not ensure that a written respiratory protection program was in place.
