29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level:  a.     At the Middleburg Bluff Apartment job site, on the roof of building #9: On or about May 28, 2020, and at times prior, two roofing employees were exposed to a free fall hazard of more than 6 feet, while attached to a personal fall arrest systems that involved 3-foot decelerating devices and 50-foot lanyards.

29 CFR 1926.503(a)(1): A training program was not provided to each employee who might be exposed to fall hazards, to enable that employee to recognize the hazards of falling, and be trained in the procedures to be followed to minimize these hazards:  a.    At the Middleburg Bluff Apartment job site, on the roof of building #9: On or about May 28, 2020, and at times prior, employees were lacking training to recognize fall hazards when working from roofs; in that, personal fall arrest systems were rigged in a manner that allowed employees to free fall more than 6 feet.  b.    At the Middleburg Bluff Apartment job site, on the roof of building #9: On or about May 28, 2020, and at times prior, employees were lacking training to recognize fall hazards, when working from roofs; in that, anchor plates were lacking fasteners, prior to allowing employees to attach their personal fall arrest systems.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a.   At the front of building #9 of the Middleburg Bluff Apartment job site:  On or about May 28, 2020, and at times prior, a  roof access ladder did  not extend at least 3 feet above the roof eave, thereby exposing employees to a 9-foot fall hazard.

At the front of building #9 of the Middleburg Bluff Apartment job site:  On or about May 28, 2020, and at times prior, the employer had not provided training to each employee using ladders, to minimize hazards relating to ladders; in that, workers used a ladder that was not adequately extended above the upper landing surface and the ladder rails were not equally supported as placed along a sloped edge.
