29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a)  At 1510 Regency Road, Regency Place Apartments Bldg. 2, Gulf Shores, Alabama:  On or about May 29, 2020 and at times prior; acting as the creating, controlling, exposing and correcting employer the employer allowed his  employees to perform framing and decking activities without first ensuring the employees were trained on the hazards associated with falls to include but not limited to setting up and inspecting fall protection exposing his employees to a fall hazard of up to 21 feet 5 inches to the ground below.  b)  At 1510 Regency Road, Regency Place Apartments Bldg. 5, Gulf Shores, Alabama:  On or about May 29, 2020 and at times prior; acting as the controlling and correcting employer the employer allowed his subcontracted employees (Joel Cruz dba Joel Cruz) to perform roofing activities without first ensuring his employees were trained on the hazards associated with falls to include but not limited to setting up and inspecting fall protection exposing his employees to a fall hazard of up to 41 feet to the ground below.

WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501 (B)(13) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1384661, CITATION NUMBER 2, ITEM NUMBER 1 AND WAS AFFIRMED AS A FINAL ORDER ON MAY 22, 2019, WITH RESPECT TO A WORKPLACE LOCATED AT SLACK ROAD, OXFORD, MISSISSIPPI AND IN OSHA INSPECTION NUMBER 1064558, CITATION NUMBER 1, ITEM NUMBER 2 AND WAS AFFIRMED AS A FINAL ORDER ON AUGUST 10, 2015, WITH RESPECT TO A WORKPLACE LOCATED AT 231 COHEA ST., JACKSON, MISSISSIPPI .
