29 CFR 1910.176(a): Use of mechanical equipment. Where mechanical handling equipment is used, sufficient safe clearances shall be allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. Aisles and passageways shall be kept clear and in good repair, with no obstruction across or in aisles that could create a hazard. Permanent aisles and passageways shall be appropriately marked. a) On or about April 22, 2020, sufficient safe clearances are not being maintained in the staging area in that a forklift struck a pallet jack due to insufficient space being present when moving a wrapped and palletized load. b) On or about June 3, 2020, there was not sufficient space on the upper dock when the forklift was making turns when loaded, pushing ten foot racks up the ramp, and turning the forklift around to come down the ramp.

29 CFR 1910.178(n)(4): The driver shall be required to slow down and sound the horn at cross aisles and other locations where vision is obstructed. If the load being carried obstructs forward view, the driver shall be required to travel with the load trailing. a) On or about June 3, 2020, a forklift was carrying a load that obstructed the forward view, and the driver was not traveling with the load trailing at the staging area and the ramp of the upper dock.

29 CFR 1910.178(l)(2)(iii): All operator training and evaluation shall be conducted by persons who have the knowledge, training, and experience to train powered industrial truck operators and evaluate their competence. a) On or about June 3, 2020, the PIV trainers did not have the knowledge, training and experience to train PIV operators on all points of operations in that they were not aware that part of the PIV operators jobs was to move large loads that obstruct their views while moving forward up the ramps without sufficient clearance to turn the PIVs.

Powered industrial truck operators shall receive initial training in the following topics: truck related topics, workplace-related topics and the requirements of this section, except in topics which the employer can demonstrate are not applicable to safe operation of the truck in the employer's workplace. a) On or about June 3, 2020 throughout the facility, powered industrial vehicle training content was not adequate in that the training content failed to address training such as but not limited to not to travel forward when the operator's view was blocked by a load, operating in areas with insufficient clearances, and pushing or bulldozing loads up ramps with the forklift.

29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition shall be removed from service. All repairs shall be made by authorized personnel. a) On or about June 3, 2020, Toyota forklift model 8FGCU25 serial number 74954 was found to be not in safe operating condition and was not removed from service in that unsafe equipment such as but not limited to the tires on the forklift were excessively cracked with chunks missing from the tires and the forks were not locking in place.
