29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a) Devael Construction LLC, at a jobsite located at Blackmore Drive Lot 2328, Delaware, Ohio 43015: On and/or preceding June 3, 2020, the employer failed to initiate and maintain a safety and health program such as but not limited to a personal protective equipment program, electrical safety program, and a fall protection program for employees conducting framing work.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Devael Construction LLC, at a jobsite located at Blackmore Drive Lot 2328, Delaware, Ohio 43015: On and/or preceding June 3, 2020, the employer did not ensure employees wore safety glasses while utilizing power tools that presented struck-by hazards to the eyes and face. Carpenters were installing roof sheathing while using pneumatic nail guns. The employees were not utilizing eye protection, which exposed them to struck-by hazards to the eyes.

Listed, labeled, or certified equipment shall be installed and used in accordance with instructions included in the listing, labeling, or certification.  a) Devael Construction LLC, at a jobsite located at Blackmore Drive Lot 2328, Delaware, Ohio 43015: On and/or preceding June 3, 2020, the employer did not ensure employees used electrical extension cords and 3-way splitters were used in accordance with instructions included in the listing, labeling, or certification. Framers were using an extension cord, plugged into a 3-way splitter, with another 3-way splitter plugged into the first, to provide electrical power to an air compressor and 3 extension cords that were used to provide power for circular saws.

The path to ground from circuits, equipment, and enclosures shall be permanent and continuous.  a) Devael Construction LLC, at a jobsite located at Blackmore Drive Lot 2328, Delaware, Ohio 43015: On and/or preceding June 3, 2020, the employer did not ensure employees who used a 3-way splitter for the extension cords were protected from electrical contact hazards. Framers were using the 3-way splitter with the ground prong missing from the male end of the splitter, which exposed the employees to a 125 volt electrical contact hazard.  b) Devael Construction LLC, at a jobsite located at Blackmore Drive Lot 2328, Delaware, Ohio 43015: On and/or preceding June 3, 2020, the employer did not ensure employees who used extension cords were protected from electrical contact hazards. Framers were using an extension cord with the ground prong missing from the male end of the cord, which exposed the employees to a 125 volt electrical contact hazard.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.    a) Devael Construction LLC, at a jobsite located at Blackmore Drive Lot 2328, Delaware, Ohio 43015: On and/or preceding June 3, 2020, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees were framing and sheathing the roof without fall protection, thereby exposed to fall hazards of up to 20 feet.

Employees were framing and sheathing the roof with lifelines and straps tied around the top of the trusses at the truss nail plate, thereby exposed to fall hazards of up to 20 feet.

Employees were framing and sheathing the roof with lifelines that were not adjusted to prevent a free fall to less than 6 feet, thereby exposed to fall hazards of up to 20 feet.
