OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to crush-by hazards: a) Salvage Yard: On June 4, 2020, and at times prior, the employer exposed employees to crush-by hazards in that employees place vehicles on a rack system that was not safely designed or constructed, and worked directly beneath the elevated vehicles to salvage automotive parts from their undercarriages.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. a) Salvage Yard: On June 4, 2020, and at times prior, the employer exposed employees to struck-by hazards in that the employer did not provide powered industrial truck training that included practical training and evaluations of the operators' performances. Sam's Used Parts, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.178(m)(5)(iii), which was contained in OSHA inspection number 1437869, citation number 1, item number 3 and was affirmed as a final order on May 13,2020, with respect to a workplace located at 55 Moss Drive, Mableton, GA 30126.
