29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (a) Facility, 114-45 87th Ave, Briarwood, NY: On and after April 19, 2020, respiratory therapists and lead respiratory therapists were required to wear tight-fitting filtering facepiece respirators including, but not limited to 3M 8200, 3M 8511, and Gerson-1730 N95 respirators while providing care to suspected or confirmed COVID-19 patients and the employer did not ensure these employees were provided a medical evaluation prior to the initial use of the respirator.
