29 CFR 1926.651(h)(1):     Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation.    On June 4, 2020, at a worksite located at 4007 Birchwood Dr, Kansas City, MO. An employee was exposed to serious injuries, in that there was standing water which continued to accumulate in the open excavation approximately 8 feet in depth due to an in-effective Sump Pump at the work site.

29 CFR 1926.652(a)(1):     Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:    On June 4, 2020, at a worksite located at 4007 Birchwood Dr, Kansas City, MO. An employee working in an 8 ft excavation was exposed to serious struck by and or engulfment hazard, in that there was no protective systems in use for work being done in the water saturated excavation.

29 CFR 1926.651(j)(2):     Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of the excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.    On June 4, 2020, at a worksite located at 4007 Birchwood Dr, Kansas City, MO. An employee working in an 8 ft excavation was exposed to serious struck by and or engulfment hazard, in that the spoils piles had not been placed at least two feet from the edge of the excavation.
