29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a) 2nd floor of new home on 430 Crazy Horse Rd: On or about June 4, 2019 and times prior, employees were installing cross braces on trusses of a new two story residential home. The employee working at floor level did not utilize head protection while the employee in the rafters worked with heavy power tools such as nail guns and saws.

29 CFR 1926.501(c)(3): The employer did not barricade the area to which objects could fall, did not prohibit employees from entering the barricaded area, and did not keep objects that could fall far enough away from the edge of a higher level so that objects would not go over the edge if they were accidently displaced. a) 430 Crazy Horse Rd: On or about June 4, 2020 and times prior, employees used power tools while working in the rafters on a new two story residential home. The area below was not barricaded to prevent entry and tools were not secured or moved to prevent falling off of the rafter beams.

The stairway was equipped with five risers and was not equipped with a stairrail system on the unprotected side.
