29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:      a) Spring Valley Rest Home LLC at 184 South Pascack Rd. Nanuet, NY 10954:     The employer did not establish and implement a written respiratory protection program for employees such as but not limited to Housekeepers, Laundry Aides, and an Assistant in charge of medications who were required to wear 3M N95 respirators when working with residents suspected or confirmed to be infected with SARS-CoV-2 coronavirus.  The violation occurred on or about 04/05/2020.     This instance also refers to OSHA inspection #s 1477917 and 1477908 opened on 6/9/2020.    NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE INSPECTION CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OF ABATEMENT FOR THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

Nanuet, NY 10954:    a) On or about 4/6/20 the employer learned of the 4/6/20 work-related death of an employee (Laundry Aide) due to COVID-19 illness but then failed to report this death to OSHA until 06/06/2020.  The violation occurred on or about 4/6/2020.  This instance refers to OSHA inspection #1477917 opened on 6/9/2020.    b) On or about 4/16/20 the employer learned of the 4/16/20 work-related death of an employee (Assistant in charge of medications) due to COVID-19 illness but then failed to report this death to OSHA until 06/06/2020.  The violation occurred on or about 4/16/2020.  This instance refers to OSHA inspection #1477908 opened on 6/9/2020.
