29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  230 Castlewood Drive, Berlin, CT: On or about June 8, 2020, an employee was exposed to head injuries from impact due to not wearing a hardhat while working in proximity to an area where roofing material was falling from heights of approximately 20 to 30 feet.

29 CFR 1926.502(d)(15): Anchorage points used for attachment of personal fall arrest equipment were not  independent of any anchorage point being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee.  230 Castlewood Drive, Berlin, CT: On or about June 8, 2020, a Werner rooftop anchor was used as part of a fall protection system. Seven nails were used to secure the anchor to the rooftop, when a minimum of 12 nails were required. The nails that were used were not used in accordance with the manufacturers installation requirements. This exposed employees to falls of heights between 20 and 30 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  230 Castlewood Drive, Berlin, CT: On or about June 8, 2020, the employer did not provide a fall protection training program to employees that were exposed to falls. Following a fall of 18 feet that led to the death of an employee, the anchor that was used was photographed at the request of the Berlin Police Department prior to it being removed for examination. The photo shows that the anchor was installed incorrectly in terms of orientation as well as not being secured in accordance with the manufacturer specifications.

29 CFR 1926.404(b)(1)(iii)(C): The employer did not ensure that each cord set, attachment cap, plug and receptacle of cord sets, and any equipment connected by cord and plug, except cord sets and receptacles which are fixed and not exposed to damage, were visually inspected before each day's use for external defects, such as deformed or missing pins or insulation damage, and for indications of possible internal damage.  230 Castlewood Drive, Berlin, CT: on or about June 9, 2020, a cord that was energizing an air compressor in the back of the house was found plugged into a GFCI and missing a grounding pin.
