29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: (a) On or about June 10, 2020, for the employees exposed to cave-in and struck-by hazards while replacing water supply pipe in a trench approximately 10 feet deep with a vertical wall where the foremen removed a trench box end plate in the vicinity of 132 East Interstate Avenue in Bismarck, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1433015, Citation 1, Item 1a, and was affirmed as a final order on December 11, 2018, with respect to a workplace located in the vicinity of Third Street North & Main Street in New Town, North Dakota.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: (a) On or about June 10, 2020, for the employees exposed to cave-in and struck-by hazards while replacing water supply pipe in a trench approximately 10 feet deep with a vertical wall where no end plate was being used with a trench box in the vicinity of 132 East Interstate Avenue in Bismarck, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1433015, Citation 1, Item 1b, and was affirmed as a final order on December 11, 2018, with respect to a workplace located in the vicinity of Third Street North & Main Street in New Town, North Dakota.
