Lukazcek Excavating & Drainage, LLC, at the work site located near the address of 7 Clearfork Ave, Pioneer, Ohio, 43554: On or about June 4, 2020, the employer did not ensure a safe means of egress such as a ladder was in place in the 6 ft. deep trench in which employees were working.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. A. Lukazcek Excavating & Drainage, LLC, at the work site located near the address of 7 Clearfork Ave, Pioneer, Ohio, 43554: On or about June 4, 2020, the employer failed to ensure material was placed at least two feet from the edge of the excavation. Employee shoveling around main drainage pipe and taking grade measurements from in the excavation were exposed to sliding/falling spoil located on the east edge of the excavation.
