The employees were exposed to a fall hazard of up to approximately 55 feet to the ground below while using the lift to remove tree limbs.

29 CFR 1910.333(c)(3): When work was to be performed near overhead lines, the lines were not deenergized and grounded, nor were other protective measures provided before work was started: a) Jobsite, 200 Crescent Gardens Drive, Pittsburgh, PA 15235: On or about May 20, 2020, overhead powerlines were not deenergized and grounded nor were other protective measures provided before work began to remove a tree with branches that were hanging above overhead power lines. On May 20, 2020, a employee was electrocuted while attempting to remove a branch from an energized (23kV) overhead power line. The employee was using a Stihl brand pole pruner (model number HT101-Z) while standing in the bucket of a Haulotte brand tow behind lift (model number 5533A, serial number 55A16-00088).

29 CFR 1910.333(c)(3)(i)(A)(1): When an unqualified person was working in an elevated position near overhead lines with voltages to ground rated at 50 kV or below, the location was not such that the person and the longest conductive object he was using could not come closer to any unguarded, energized overhead line than the 10 feet (305 cm): a) Jobsite, 200 Crescent Gardens Drive, Pittsburgh, PA 15235: On or about May 20, 2020, an employee who was using a Stihl brand pole pruner (model number HT 1010-Z) and a Haulotte brand tow behind lift (model number 5533A, serial number 55A16-00088) to remove tree branches near overhead power lines was working in a location such that the pole pruner and the lift could come within 10 feet of the overhead power lines. Neither the pole pruner nor the lift was insulated. On May 20, 2020, a employee was electrocuted while attempting to remove a branch from an energized (23kV) overhead power line. He was using a Stihl brand pole pruner (model number HT101-Z) while standing in the bucket of a Haulotte brand tow behind lift (model number 5533A, serial number 55A16-00088).

The employer did not report the death to OSHA until June 12, 2020.
