29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) New residential construction, roof: On or about June 11, 2020, and at times prior, the employer exposed employees to falls of 25 feet from the lower level, in that a personal fall arrest system was not provided to employees while conducting roofing work installing shingles on a 6:12 pitched roof.

29 CFR 1926.552(a)(1): The employer shall comply with the manufacturer's specifications and limitations applicable to the operation of all hoists and elevators. Where manufacturer's specifications are not available, the limitations assigned to the equipment shall be based on the determinations of a professional engineer competent in the field. a) New residential construction: On or about June 11, 2020 the employer exposed employees to fall hazards in that employees were allowed to use the Tranzporter (modelLH200) platform hoist as a ladder to access the roof. The manufacturer's general safety instructions state that this hoist should never be used as a ladder.
