29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Agriculture Reference: 1928.21(a)(5)): A written chemical hazard communication program was not available at the time of the inspection. Not all employees were aware of a written chemical hazard communication program that described how labeling of chemicals, how safety data sheets were maintained and made available, how training was provided (including information and training), and that included a description of how employees would be made aware of the potentials of non-routine tasks and the procedures during the use of chemicals for a non-routine task. Abatement documentation is required for this violation.

29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work shift to employees when they were in their work area(s): At the time of the inspection, safety data sheets, were not present and available for chemical products such as, but not limited to, Barnstorm and Synergize. No safety data sheets were available for potential exposure to ammonia and hydrogen sulfide. Abatement documentation is required for this violation.
