On or about June 16, 2020, an employee on apartment building L, 5:12 pitch roof, operated a pneumatic nailer to attach shingles without the use of eye protection, being exposed to struck-by nails and flying debris.

29 CFR 1926.501(b)(13): 29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, a personal fall arrest system, or an alternative fall protection measure as provided by another provision in paragraph (b) of this section: a. On or about June 16, 2020, an employee attached new shingles along the roof peak of the 5:12 pitch roof on the 2-story multifamily unit Building L, without the use of any fall protection system, exposed to a 17-foot 4-inch fall hazard onto the ground below.
