29 CFR  1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met:  a) Bookcliff Gardens, LTD at 775 26 Road in Grand Junction, CO: On or about June 4, 2020 the employer did not develop a written hazard communication program containing the required elements. Employees use pesticides for horticulture activities in the greenhouses on-site, including the following:   -Talstar-P  -Mavrik Aquaflow -Safari  This condition exposed employees to chemical hazards.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  a) Bookcliff Gardens, LTD at 775 26 Road in Grand Junction, CO: On or about June 1, 2020 the employer did not ensure that each employee working on a walking/working surface with an unprotected side or edge which is 6 feet or more above a lower level was protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. Two employees were working on a greenhouse roof while replacing roof panels. This condition exposed one employee to fall hazards of approximately 10 ft. Another employee fell approximately 17 feet from the apex of the greenhouse roof to the ground, resulting in his death.

29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures:  a) Bookcliff Gardens, LTD at 775 26 Road in Grand Junction, CO: On or about June 1, 2020 the employer did not establish and implement a written respiratory protection program with worksite-specific procedures in a workplace where respirators are necessary to protect the health of the employee or wherever respirators are required by the employer. Employees wear half face elastomeric respirators while spraying pesticides in a greenhouse. This condition exposed employees to respiratory hazards.
