29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  On or about June 17, 2020 and at times prior thereto, the employees performing masonry activities were not provided a ladder to access and egress the upper levels of a pole scaffold and were exposed to fall hazards.

29 CFR 1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:  On or about June 17, 2020 and at times prior thereto, employees were exposed to fall hazards due to scaffold components were not inspected by a competent person prior to each work shift.

29 CFR 1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity).  On or about June 17, 2020 and at times prior thereto, the employer exposed employees to fall hazards due to no guardrails were installed on the scaffold.

29 CFR 1926.451(h)(2)(ii): A toeboard was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below:Note:  This requirement does not apply to float (ship) scaffolds where an edging of 3/4 inch x 1 1/2 inch (2 x 4 cm) wood or equivalent was used in lieu of toe-boards.  On or about June 17, 2020, and at times prior thereto, employees were exposed to struck-by hazards due to toe-boards not being installed to prevent bricks from falling on employees.
