29 CFR  1910.134(c)(1):  A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  Dental Office:  On, or about, May 20, 2020, the practice had not developed and implemented a written respiratory protection program to address the use of N95 and KN95 filtering facepieces that were required to be worn by staff who were potentially exposed to respiratory hazards caused by the SARS-CoV-2 virus which causes Coronavirus Disease 2019 (COVID-19).  Staff members worked in close proximity to patients whose dental care required the use of high-speed instruments that could aerosolize droplets, which is believed to be the primary mode of transmission of the SARS-CoV-19 virus.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  Dental Office:  On, or about, May 20, 2020, the practice had not provided medical evaluations to employees who were required to wear N95 and KN95 filtering facepieces during dental procedures where exposure to the SARS-CoV-19 virus could occur.  Staff members worked in close proximity to patients whose dental care required the use of high-speed instruments that could aerosolize droplets, which is believed to be the primary mode of transmission of the SARS-CoV-19 virus.

29 CFR 1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator:  Dental Office:  On, or about, May 20, 2020, the practice had not provided an initial fit-test to each employee who was  required to wear N95 and KN95 filtering facepieces during dental procedures where exposure to the SARS-CoV-19 virus could occur.  Staff members worked in close proximity to patients whose dental care required the use of high-speed instruments that could aerosolize droplets, which is believed to be the primary mode of transmission of the SARS-CoV-19 virus.
