29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  On or about June 17, 2020 at the above addressed jobsite, employees were using pneumatic nail guns and were not wearing safety glasses, thereby exposing the employees to hazards associated with eye injuries.  Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about June 17, 2020 at the above addressed jobsite, the portable ladder used to access the roof did not extend at least three (3') feet above the upper landing surface, thereby exposing employees to the hazards associated with falls.  Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  On or about June 17, 2020 at the above addressed jobsite, employees were performing roofing operations approximately 22 feet 10 inches above ground and were not using fall protection, thereby exposing employees to fall hazards.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).  Prieto Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.501(b)(13), which was contained in OSHA inspection number 1166959, citation number 1, item number 1 and was affirmed as a final order on October 12, 2016, with respect to a workplace located at 121 W. Union Ave, Wheaton, Illinois 60187.
