29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a power industrial truck:(Construction Reference: 1926.602(d))  A) On or about June 17, 2020, 57 Derby Way, Glastonbury, CT job site:   The employer used a Lull forklift to support a scaffold platform, loaded with lumber.   Training on powered industrial truck operation was not provided.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   A) On or about June 17, 2020, 57 Derby Way, Glastonbury, CT job site:  The employer did not provide a guardrail system or other form of fall protection to the employees preventing fall into an unguarded stairway opening.  The landing area at the top of the stairway was unprotected on a 6 foot side and 4 foot edge and was located 8 feet above the lower level.

29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.   A) On June 17, 2020, at 57 Derby Way, Glastonbury, CT job site, Second Floor:  The employer did not provide a guardrail system or other means of fall protection to prevent falls from wall openings.  The wall opening was 20 feet wide and the bottom outside edge was more than 8 feet and 4 inches  above the ground level.   The wall opening had an inside edge of 24 inches from the floor.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   A) On or about June 17, 2020, at 57 Derby Way, Glastonbury, CT job site:  The employer did not assure that each employee had been trained, as necessary, by a competent person qualified in the nature of fall hazards in the work area; the correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems; or the use and operation of a Fall protection systems.  Employees were exposed to falls at unguarded stairwell openings and window openings.
