Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: a) Greenhouse #2, House 8, Row 21036, on or about 6/4/2020: Floor hole, 30-inches in diameter x 15-inches deep, was not provided with a cover to prevent employees from stepping into it and falling. An employee accidentally stepped into this uncovered floor hole while moving a cart which resulted in an injured back and knee. Among other feasible and acceptable means of abatement would be to install covers over the open floors holes to comply with the American National Standards Institute, ANSI, Standard A1264.1-2017, Safety Requirements for Workplace Walking/Working Surfaces and Their Access; Workplace Floor, Wall and Roof Openings; Stairs and Guardrail/Handrail Systems. Railings, Section 3 - Protection of Floor and Roof Openings and Holes.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to emergency egress hazards: a) Greenhouse #1, on or about 6/18/20: The employer did not provide exit doors for employee use to quickly and safety exit the building in the event of fire or other emergency. This greenhouse is approximately 820 feet wide x 2,625 feet long and has zero personnel doors and one overhead door at the East end and one overhead door at the West end. b) Greenhouse #2, on or about 6/18/2020: The employer did not provide exit doors for employee use to quickly and safety exit the building in the event of fire or other emergency. This greenhouse is approximately 820 feet wide x 2,625 feet long and has zero personnel doors and one overhead door at the East end and one overhead door at the West end. Among other feasible and acceptable means of abatement would be to install exits doors in numbers and design that meet the criteria outlined in (NFPA) National Fire Protection Association Life Safety Code 101-2018 including but not limited to: Chapter 7 Means of Egress, Section 7.4 - Number of Means of Egress; Chapter 40 - Industrial Occupancies, Section 40.2 Means of Egress Requirements and Tables 40.2.5.1 - Arrangement of Means of Egress and Table 40.2.6.1 - Maximum Travel Distance to Exits.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to emergency egress hazards: a) Green Empire Farms, Inc., on or about 6/18/20: Exit doors throughout the facility were not marked with signs such as, "Exit" and "Not An Exit", to indicate their purpose. b) Green Empire Farms, Inc., on or about 6/18/20: Exit routes throughout the facility were not marked with signs to indicate the direction of travel to the nearest exit. Among other feasible and acceptable means of abatement would be to install exit signs and directional exit signs in accordance with (NFPA) National Fire Protection Association Life Safety Code 101-2018, Chapter 7 Means of Egress, Section 7.10 Marking of Means of Egress.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazards of unsafe powered industrial truck operations: a) Green Empire Farms, Inc., on or about 6/18/20: The employer did not ensure that employees operating powered industrial trucks, such as but not limited to, Raymond Pacer electric stand-up lifts, received training prior to operation. Among other feasible and acceptable means of abatement would be to comply with ANSI/ITSDF B56.1 Safety Standard for Low Lift and High Lift Trucks operator qualifications and training, Sections 4.18 and 4.19 and to comply with the powered industrial truck manufacturer's operating instructions.
