29 CFR  1926.20(b)(1):The employer did not initiate and maintain such programs as may be necessary to comply with this part:  A)	Next Generation Roofing, conducting work at 5532 Harris Hawk Lane, Sylvania, OH 43560: On or about June 18, 2020, the employer did not have a plan or program to identify job site hazards, which assists employees in maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards such as, but not limited to, falls during job site operations.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  A)	Next Generation Roofing, conducting work at 5532 Harris Hawk Lane, Sylvania, OH 43560: On or about June 18, 2020, the employer did not ensure that employees were adequately trained in the appropriate use of fall protection such as, but not limited to, the use of personal fall arrest systems, or alternative measures of fall protection while conducting framing activities atop the first level of the residential structure. Employees were exposed to approximately 11 feet fall hazard from the structure to the ground below.

29 CFR  1926.95(a):Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact:  A)	Next Generation Roofing, conducting work at 5532 Harris Hawk Lane, Sylvania, OH 43560: On or about June 18, 2020, the employer did not ensure that employees were using appropriate eye protection such as, but not limited to, safety glasses while conducting construction work with equipment such as, but not limited to, a pneumatic nail gun. Employees were exposed to the hazards of eye injury from flying object.
