29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels were not protected from falling by guardrail systems with toe boards, safety net systems, or personal fall arrest systems: (a)Falcon Roofing LLC at 1800 South Valley View Road, Sioux Falls, SD 57106: On or about and at times prior to June 19, 2020, the controlling and exposing employer did not ensure employees and subcontractor employees were protected from fall hazards by utilizing a personal fall arrest system while working on the roof installing asphalt shingles on a commercial 5-in-12 pitched roof over six feet from the ground. Subcontractor employees were engaged in re-roofing activities without the use of a fall protection system. This condition exposed employees and subcontractor employees to fall hazards of approximately 12 to 20 feet.
