29 CFR 1926.601(b)(4): The employer had in use motor vehicle equipment having an obstructed view to the rear which did not have a reverse signal alarm audible above the surrounding noise level or an observer signaling it was safe to operate the vehicle in the workzone. (a) Brannan Sand and Gravel Company, LLC at East of Sheridan Blvd on Highway 7, Broomfield, CO 80023: On June 8, 2020, the controlling and exposing employer did not ensure that a dump truck used in a work zone had an unobstructed view to the rear and either a reverse signal alarm that was audible above the surrounding noise level or an observer signaling it was safe to operate the vehicle. A dump truck reversed and backed up in the work zone to deliver asphalt to employees when an employee was struck by the truck and sustained serious injuries. The dump truck had an obstructed view to the rear, did not have an audible back up alarm, nor was an observer utilized. This condition exposed employees to struck-by hazards.
