29 CFR 1926.20(b)(2): The employer did not initiate and maintain an accident prevention program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):  (a)Sioux Dairy Construction, Inc. at 25971 456th Avenue, Humboldt, SD 57035: On or about and at times prior to June 22, 2020, the controlling employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. On June 22, 2020, subcontractor employees were working from heights without a fall protection system in place. Additionally, subcontractor employees were working without the use of personal protective equipment including head protection, and high visibility clothing while walking and working around multiple pieces of heavy equipment on the jobsite. The condition exposed employees to fall and struck-by hazards.   Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.  Sioux Dairy Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1269141, citation number 1, item number 1, and was affirmed as a final order on December 21, 2017, with respect to a workplace located at 45144 289th Street, Viborg, SD 57070.
