29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  Lot 148, Unit 45, front of house by equipment hoist:  On or about 06/24/2020, an employee without head protection (working at ground level) was exposed to struck-by hazards in that a powered hand tool (a 5.7 lb. nail gun) and 50 lb. bundles of shingles were lifted to a second employee, who was working on the upper level at the peak of the roof.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    Lot 148, Unit 45, front roof: On or about 06/24/2020, while in the process of   installing drip edge and loading shingles on to the roof of a two story residential dwelling employees were not protected from a fall hazard by conventional fall protection and/or devices. Employees were exposed to fall hazards from a height of approximately 20 or more feet from eave height to ground level.

29 CFR  1926.1051(a):Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided:(a) (LOCATION) (IDENTIFY SPECIFIC OPERATION(S) AND/OR CONDITIONS)  Lot 148, Unit 45, front: On or about 06/24/2020, the employer exposed employees to potential fall hazards of 19 feet 4 inches by allowing three employees to use a Tranzsporter TP 250, as a ladder for accessing and descending from the roof of a two story residential dwelling. The hoist is designed equipment and/or material hoisting only, and not a personnel ladder as stated in the owner�s manual.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  Lot 148, Unit 45, Roof: On or about 06/24/2020, while in the process of completing residential construction (including the installation of drip edge and loading shingles on to the roof of a two story residential dwelling) the employer did not ensure that employees using pneumatic nail guns were protected from eye and/or face injuries. Employees were observed using a Matabo HTP coil nailer(s) to affix drip edge, and flashing without safety eyewear or facial protection.

29 CFR 1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  Lot 148, Unit 45: On or about 06/24/2020, the employer did not have written training certification/certificates for employees who were exposed to fall hazards while working 20 feet or more above ground level from a two story residential building under construction.
