OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to potential crush hazards associated with not wearing seatbelts while operating the forklift: a.) Kinzua Water Treatment, Inc. dba Culligan Water, Forklift loading area, on or about June 26th, 2020 and times prior thereto: Employees were not wearing seatbelts while operating a forklift. Employees were operating a CAT brand forklift (Serial #AT3500146) without wearing a seatbelt. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation. This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.

A complete hazard assessment was not conducted for employees that performed work tasks including, but not limited to, handling, and hand pumping muriatic acid and caustic soda liquid during water treatment operations in that, eye and/or face protection was not required while working with corrosive materials. The emergency eyewash (plumbed) was not in compliance with ANSI/ISEA 358.1-2014 for Emergency Eyewash and Shower Equipment in that: 1. Weekly visual inspections of the eyewash station were not conducted. 2. The emergency eyewash unit was not activated weekly to verify proper operation.
