OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards: a) Retention pond located behind a Walmart - 2225 North 2nd. Street, Millville NJ 08332: Employees using the DIXIE CHOPPER S/N 18000534 did not have the Roll Over Protective Structure (ROPS) in place to prevent bodily injury while the lawn mower was used near slopes or ditches, occurred on or about 06/26/2020.

29 CFR 1904.39(a)(1): Within eight (8) hours after the death of any employee as a result of a work-related incident, the employer did not report the fatality to the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor. a) 2281 Delsea Drive, Franklinville, NJ 08322: The employer did not report to OSHA the death of an employee within eight (8) hours after it occurred on 6/28/2020. The Southern Regional medical examiner contacted OSHA on 6/30/2020 to report the death of the employee that occurred at the hospital.
