OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a) Concrete pad front of shop: On or about June 29, 2020 and at times prior employees were exposed to struck by hazards while elevating vehicles on the Bend-Pak Model ML-6 Automotive Lift that contained an unapproved, and unrated home made attachment. b) Concrete pad front of shop: On or about June 29, 2020 and at times prior employees were exposed to struck by hazards while elevating vehicles on the Bend-Pak Model ML-6 Automotive Lift that contained weld repairs that were not approved by a qualified automotive lift inspector. c) Concrete pad front of shop: On or about June 29, 2020 and at times prior employees were exposed to struck by hazards while elevating vehicles on the Bend-Pak Model ML-6 Automotive Lift that contained a failing roller that would cause the automotive lift to bind and lift unevenly. d) Concrete pad front of shop: On or about June 29, 2020 and at times prior employees were exposed to struck by hazards while elevating vehicles on the Bend-Pak Model HD-9XW & Bend-Pak Model ML-6 Automotive Lifts that had not been inspected. e) Concrete pad front of shop: On or about June 29, 2020 and at times prior employees were exposed to struck by hazards while elevating vehicles on the Benk-Pak Model HD-9XW that was not placed on a level surface or shimmed to prevent the automotive lift from side loading and collapsing.
