29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or when such an extension was not possible because of the ladder's length, the ladder was not secured at its top to a rigid support that will not deflect and a grasping device, such as a grabrail was not provided to assist employees in mounting and dismounting the ladder: (a) Main Building - An aluminum step ladder was used to access the roof that did not have enough length to be extended at least three rungs above the landing was not secured or have a grasping device exposing employees to falls of greater than fifteen (15) feet. (b) Smaller Building - A fiberglass extension ladder was used to access the roof without extending three (3) feet or more above the landing exposing employees to falls of greater than ten (10) feet.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: (a) Main building - Employees were engaged in roofing activities without the use of fall protection on a roof that was approximately a twelve (12) pitch roof where the edge was greater than nine (9) feet above the concrete and pavement below exposing them to falls. (a) Smaller building - Employees were engaged in roofing activities without the use of fall protection on a roof that was approximately a twelve (12) pitch roof where the edge was greater than ten (10) feet above the concrete and pavement below exposing them to falls. JQ Construction, Inc. was previously cited for a violation an equivalent of this occupational safety and health standard, 1626.501(b)(13), which was contained in OSHA inspection number 1323236, citation number 1, item number 1, and was affirmed as a final order on 11 December 2018, with respect to a workplace located at 385 Pearl Street, Brockton, MA.
