29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems: On or about July 1, 2020, an employee was replacing a gutter and working from the roof that was approximately 9.5 feet above ground and the employee was not wearing any fall protection. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d). Ned Stevens Gutter Cleaning & General Contracting of Illinois, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.28(b)(1)(i) which was contained in OSHA inspection number 1438855, citation number 1, item number 1 and was affirmed as a final order on April 9, 2020, with respect to a workplace located at 2530 Palmer Court, Riverwoods, IL 60015.
