29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: (a) On or about July 2, 2020, for the employees exposed to cave-in and struck-by hazards while installing a stop valve in an excavation approximately 7.5 feet deep where the means of egress was blocked by a 10 inch gas line and a lack of excavation protection in the vicinity of 1214 East Avenue C in Bismarck, North Dakota. Note: This company was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA Inspection Number 1356620, Citation 1, Item 1a, and was affirmed as a final order on February 13, 2019, with respect to a workplace located at 5612 Niagara Drive in Bismarck, North Dakota.
