29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) Elmwood Hills Healthcare Center LLC dba Northbrook Behavioral Health Hospital LLC - Unit One South located at 425 Woodbury Turnersville Road, Blackwood, NJ: On or about May 29, 2020, the employer did not ensure that a certified nursing assistant / psychiatric aide who used a half mask elastomeric negative pressure respirator was provided a medical evaluation to determine the employee's ability to use a respirator. The employer required employees to wear respirators while providing care to suspected and confirmed positive COVID-19 patients. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

The employer did not ensure that a certified nursing assistant / psychiatric aide who used a half mask elastomeric negative pressure respirator to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 patients.
