29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8 hour time-weighted average sound level of 85 decibels measured on the A scale (dBA), or equivalently a dose of fifty percent:  Employer is failing to ensure that an effective hearing conservation program was implemented for employee(s) exposed to 8 hour time-weighted average noise levels exceeding 85 dBA. An employee operating the assembly unit in the assembly room was exposed to continuous 8 hour time-weighted average noise levels of 98.5 A-weighted decibels (dBA) or the equivalent dose of 326.7% during the 383 minutes sampled on July 20, 2020. Exposure calculations include a zero increment for the 97 minutes not sampled.
