29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b).  a) Worksite, residential structure, south basement wall:   On or about July 6, 2020, an employee working approximately 14 feet above the ground standing on top of the unfinished wall was not provided with guardrail systems, safety net systems, personal fall arrest systems, or any other type of fall protection.  Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR  1926.651(l): Guardrails complying with 1926.502(b) were not provided where walkways were 6 feet (1.8m) or more above lower levels:  a) Worksite, residential structure, south basement wall:   On or about July 6, 2020, an employee accessed a cast-in-place concrete basement wall from the edge of an excavation using a wood plank and was not provided with guardrails or any other type of fall protection.  Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR  1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  a) Worksite, inside excavation, between south residential wall and excavation wall:  On or about July 6, 2020, employees were performing removal of cast-in-place concrete forms while standing in an unprotected excavation.  Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
