29 CFR 1910.178(m)(5)(ii): A powered industrial truck was unattended and the operator more than 25 feet away from the vehicle: (a)G.A. Johnson Construction, Inc. at 272nd Street & 472nd Avenue, Harrisburg, SD 57032: On or about and at time prior to July 7, 2020, the employer did not ensure that an operator was within 25 feet of the Caterpillar, Model TH63 Rough Terrain Forklift. The forklift was being used to lift personnel to conduct welding operations. The operator left the Powered Industrial Truck unattended with a suspended load to assist in welding activities on the roof of the property. This condition exposed the employees to the hazards of unsafe forklift operation.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1m) above a lower level was not protected from falling to that lower level by fall protection established in accordance with paragraphs (g)(1)(i) through (vii) of this section: (a)G.A. Johnson Construction, Inc. at 272nd Street & 472nd Avenue, Harrisburg, SD 57032: On or about and at time prior to July 7, 2020, the employer did not ensure that employees were protected from falls while working from a personnel basket attached to a rough-terrain forklift. An employee stood on the top rail of a personnel basket to assist in welding operations. This condition exposed an employee to a fall hazard of approximately 20 feet.

Johnson Construction, Inc. at 272nd Street & 472nd Avenue, Harrisburg, SD 57032: On or about and at times prior to July 7, 2020, the employer did not ensure employees were protected from falls while conducting welding activities on the roof of a commercial building under construction. Employees were working in close proximity to the edge of a roof without a fall protection system in place. This condition exposed employees to fall hazards of 19 to 24 feet.
