29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a) Brooklyn-Anthony & Robert Construction, Inc. / dba BAR Construction at 12497A York Street in Thornton, CO 80241: On or before July 1, 2020, the employer did not ensure that each employee on the jobsite was trained on safety and health hazards in trenching operations. Two employees were installing sewer connection in a trench greater than 5 feet deep without any safety training regarding the hazards associated with this work. This condition exposed employees to cave-in and struck-by hazards.

Employees were installing a sewer connection in a trench more than 5 feet deep without any means of egress in Type B soil. This condition exposed employees to cave-in and struck-by hazards.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: (a) Brooklyn-Anthony & Robert Construction, Inc. / dba BAR Construction at 12497A York Street in Thornton, CO 80241: On or before July 1, 2020, the employer did not ensure that daily inspections of the trench were conducted by a competent person. The employer failed to identify hazardous conditions that would require the use of a trench box or other means of shoring. These hazardous conditions included but are not limited to: a 5 foot trench with vertical walls cut into Type B soil and a potential for traffic vibration. Employees were installing a sewer connection in a trench more than 5 feet deep without any means of shoring in Type B soil. This condition exposed employees to cave-in and struck-by hazards.

(a) Brooklyn-Anthony & Robert Construction, Inc. / dba BAR Construction at 12497A York Street in Thornton, CO 80241: On or before July 1, 2020, the employer did not ensure that employees working inside a trench with vertical walls were protected from cave-in, in that employees were installing sewer connection without a trench box or other means of shoring. The trench was approximately 5 feet in depth, 4 feet in width, and 4 feet in length. This condition exposed employees to a crushing hazard by excavation wall cave-in.
