OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that  employee(s) were exposed to the hazard of excessive heat:  a)  On or about July 07, 2020, at the State Route 63, Genesee River Bridge Project, located in Geneseo, New York, employees performing light duty work, including sorting and assembling bolts for bridge railing assembly, were exposed to the hazards of excessive heat generated by air temperatures of 96 degrees Fahrenheit, with no shade.  Such exposure may lead to the development of heat related illness such as heat stroke, heat stress, heat exhaustion or death.  On July 7, 2020, an employee died from hyperthermia.  The effective Wet Bulb Globe Temperature (WBGTeff) was calculated to be 32 �C with a metabolic rate at 188.2,  which exceeds the recommended action level and  threshold  limit value (30.5 �C) set by the American Conference of Governmental Industrial Hygienists (ACGIH)  for calculated Metabolic Rate based on a continuous light workload for this employee.  Additionally, the employee was not acclimated to the hot environment, having started his employment on July 6, 2020.  The employee was also wearing a visi vest over his shirt.
