29 CFR 1910.266(f)(2)(v): Before starting or moving any machine, the operator shall determine that no employee is in the path of the machine. (a) Cow Creek Band of Umpqua Indians Reservation - Interstate-5, Exit 93, Logging section 23- On or about July 7, 2020 and at times prior thereto, the operator of the Caterpillar 325 L Shovel (serial * 8NK00470*) did not ensure an employee was in the path of the machine while rearranging logs at the landing. The employee was run over by the tracks of the shovel resulting in hospitalization.

29 CFR 1910.266(f)(3)(xii): Transparent material that may create a hazard for the operator, such as but not limited to, cracked, broken or scratched safety glass, shall be replaced. (a) Cow Creek Band of Umpqua Indians Reservation - Interstate-5, Exit 93, Logging section 23- On or about July 7, 2020 and at times prior thereto, the Caterpillar 325 L Shovel (serial * 8NK00470*) was operated with a broken windshield. This exposed employees to contact with the shovel or logs in that the operator may not be able to easily view employees or other obstructions.
