29 CFR  1926.1408(a)(2)(iii)(B): Where it was determined that any part of the equipment, load line or load (including rigging and lifting accessories), while operating up to the equipment's maximum working radius in the work zone, could get closer than the minimum approach distance of the power line permitted under Table A (see � 1926.1408), the requirements in paragraph (b) of this section were not met:   a)  Madison Dam Civil Project:  On or about July 13, 2020 and at times prior, IMCO General Construction, Inc. as the exposing/controlling employer, did not ensure their employees and employees of sub-contractor, Associated Underwater Services, Inc. were protected in that employees were exposed to electrical shock and burns. Employees were exposed to electrical shock and burns while placing concrete blocks within the minimum approach distance of the energized 100,000-volt overhead transmission line with a Link Belt TCC 750 crane.

29 CFR 1926.1408(b)(4)(ii)(A): The employer did not equip a visual aid to assist in identifying the minimum clearance distance.  Examples of a visual aid include, but are not limited to: A clearly visible line painted on the ground; a clearly visible line of stanchions; a set of clearly visible line-of-sight landmarks (such as a fence post behind the dedicated spotter and a building corner ahead of the dedicated spotter):   a) Madison Dam Civil Project:  On or about July 13, 2020 and at times prior, IMCO General Construction, Inc. as the exposing/controlling employer, did not ensure their employees and employees of sub-contractor, Associated Underwater Services, Inc. were protected in that employees were exposed to electrical shock and burns. The employer failed to ensure a visual aid was used to prevent encroachment into the minimum approach distance and accidental contact with the 100,000-volt overhead transmission lines.

29 CFR 1926.1408(b)(4)(ii)(B): The employer did not have a dedicated spotter positioned to effectively gauge the clearance distance:   a) Madison Dam Civil Project:  On or about July 13, 2020 and at times prior, IMCO General Construction, Inc. as the exposing/controlling employer, did not ensure their employees and employees of sub-contractor, Associated Underwater Services, Inc. were protected in that employees were exposed to electrical shock and burns. The employer failed to provide a designated and dedicated crane spotter to prevent encroachment into the minimum approach distance and accidental contact with the 100,000-volt overhead transmission lines.

29 CFR 1926.1430(b): The employer did not train each employee assigned as a signal person who did not meet the requirements of 1926.1428(c) in the areas addressed in that paragraph:   a) Madison Dam Civil Project:  On or about July 13, 2020 and at times prior, IMCO General Construction, Inc. as the exposing/controlling employer, did not ensure their employees and employees of sub-contractor, Associated Underwater Services, Inc. were protected in that employees were exposed to electrical shock and burns.  Employees were exposed to shock and burns while placing concrete blocks below the energized 100,000 volt overhead power lines with a Link Belt TCC 750 crane.  Employees were exposed to shock and burns while placing concrete blocks below the energized 100,000-volt overhead power lines with a Link Belt TCC 750 crane. The employer failed to train the assigned signal person know and understand: the type of signals used, the Standard Method for hand signals, the application of the type of signals used, equipment operation and limitations, the relevant requirements of 1926.1419 through 1926.1422 and 1926.1428, and demonstrate that the requirements in paragraphs (c)(1) through (4) of this section were met through oral and practical testing.
