29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: (a) J & E Hernandez Construction at 1600 East 77th Street, Sioux Falls, SD 57104: On or about and at times prior to July 9, 2020 the exposing employer did not ensure that employees were protected from falls while accessing the upper level of the fourth floor walking platform to gain access to the roof hatch. This condition exposed employees to a fall hazard of 11 feet.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toe boards, safety net systems, or personal fall arrest systems: (a)J & E Hernandez Construction at 1600 East 77th Street, Sioux Falls, SD 57104: On or about and at times prior to July 9, 2020 the exposing employer did not ensure that employees that were performing roofing activities on a four story commercial property were protected from falls by a fall protection system. This condition exposed employees to a fall hazards of approximately 40 feet. J & E Hernandez Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1437971, citation number 2, item number 1 and was affirmed as a final order on October 18, 2019, with respect to a workplace located at 4505 South Cliff Avenue, Sioux Falls, SD, 57103.
