29 CFR 1926.1413(a)(1): A competent person did not begin a visual inspection prior to each shift the equipment is used and/or did not complete the visual inspection before or during that shift. On or about July 10, 2020, and at times prior thereto, employees were exposed to a struck-by hazard when using a wire rope that exhibited strand protrusion to lift and pull a telephone pole on a Mack truck-mounted hydraulic boom.

29 CFR 1926.1427(a): The employer did not ensure that each operator is trained, certified/ licensed, and evaluated in accordance with this section before operating any equipment covered under subpart CC, except for the equipment listed in paragraph (a)(2) of this section: On or about July 10, 2020, and at times prior thereto, employees were exposed to a struck-by hazard when operating a Mack truck-mounted hydraulic boom to lift and pull a telephone pole without the operator being trained and certified/licensed.
