29 CFR 1926.451(a)(6): Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section. On July 14, 2020 at 1338 W Prospect Avenue in Appleton, WI, an employee was working from a homemade personnel platform supported by a CAT TL642C telehandler twenty-four feet above surface level which was not designed by a qualified person; Oriented Strand Board (OSB) work surface, ratchet strap used to secure the platform to the lifting mechanism, no toe plate installed, and no capacity information plate attached.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level; for all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. On July 14, 2020 at 1338 W Prospect Avenue in Appleton, WI, an employee was working from a personnel platform supported by a CAT TL642C telehandler twenty-four feet above surface level without utilizing fall protection equipment.

29 CFR 1926.454(a)(1): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards; the training shall include the nature of any electrical hazards, fall hazards and falling object hazards in the work area. On July 14, 2020 at 1338 W Prospect Avenue in Appleton, WI, the employer did not provide required scaffold safety training for an employee who did not associate fall from elevation hazards when working from personnel platform supported by a CAT TL642C telehandler without the guardrail system installed.
