29 CFR 1926.451(c)(1)(ii): Supported scaffolds with a height to base width (including outrigger supports, if used) ratio of more than four to one (4:1) were not restrained from tipping by installing guys, ties, and braces:  a) Northwest corner of building: On or about July 8, 2020 and at times prior thereto employees performed masonry activities from a multi-leveled scaffold system that was not secured to the building.  The highest working platform was 26 feet high.       Note) Corrected during inspection.

29 CFR 1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:  a) Northwest corner of building: On or about July 8, 2020 and at times prior thereto the competent person failed to recognize that no scaffold bracing was in place on a 26 foot high scaffold system.  A green serviceable tag for the scaffold had been signed off.  Employees performed masonry activities from the 26 foot high scaffold system.         Note) Corrected during inspection.

29 CFR 1926.1153(g)(1): The employer did not establish and implement a written exposure control plan:  a) Jobsite: On July 8, 2020 and at times prior thereto the employers written silica exposure control plan did not identify which job tasks would expose employees to silica, what engineering controls, work practices, and housekeeping measures would be implemented, or how access would be restricted to the work area if needed. An employee was injured on May 6, 2020.  The workman's compensation form showed the employee did not return to work until May 11, 2020.
