29 CFR 1904.4(a): The employer did not record each work-related fatality that resulted in the general recording criteria on the OSHA Form 300 or equivalent: a) Magnolia Nursing and Rehabilitation located at 1105 N Magnolia Avenue, Luling, TX 78648: On or about June 13, 2020, an employee was hospitalized as a result of a confirmed case of COVID-19 and died on or about June 18, 2020. The employer did not record the work-related fatality on the OSHA 300 log or its equivalent. b) Magnolia Nursing and Rehabilitation located at 1105 N Magnolia Avenue, Luling, TX 78648: On or about June 21, 2020, an employee was hospitalized as a result of a confirmed case of COVID-19 and died on or about June 24, 2020. The employer did not record the work-related fatality on the OSHA 300 log or its equivalent.

29 CFR 1904.39(a)(1): Within eight (8) hours after the death of an employee as a result of a work-related incident, the employer did not report the fatality to the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor: a) Magnolia Nursing and Rehabilitation located at 1105 N Magnolia Avenue, Luling, TX 78648: On or about June 18, 2020, an employee died of COVID-19. The employer did not report the work-related fatality to OSHA within 8 hours. The employer reported the death to OSHA on July 15, 2020 after being contacted for confirmation based on data from the CMS (Centers for Medicare & Medicaid Services) database showing two staff deaths from Covid-19. b) Magnolia Nursing and Rehabilitation located at 1105 N Magnolia Avenue, Luling, TX 78648: On or about June 24, 2020, an employee died of COVID-19. The employer did not report the work-related fatality to OSHA within 8 hours. The employer reported the death to OSHA on July 15, 2020 after being contacted for confirmation based on data from the CMS (Centers for Medicare & Medicaid Services) database showing two staff deaths from Covid-19.
