OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to crushing hazards from operating a powered industrial truck without a seatbelt: A. On or about July 16, 2020, Warehouse and Outside Lot Areas: An employee was observed operating the Toyota propane-powered forklift, Model 7FGU35, without wearing the seatbelt provided on the equipment. Powered industrial trucks were used to carry loads varying in weights from 50 pounds up to 5000 pounds.
